Birmingham restaurateur to launch legal challenge against Tier 3 restrictions
Sam Morgan, who owns fine-dining restaurant and bar Craft at The International Convention Centre, is seeking a judicial review of the restrictions that are in place across large swathes of northern England and the Midlands.
Morgan is backed by 256 businesses from across the region, who have joined forces under the newly-established Birmingham Hospitality Group.
As well as demanding to see data to support the decision to keep hospitality businesses closed in Tier 3 areas, the group is also calling for the Government to provide adequate financial support in order for the sector to survive.
The group intends to send a letter directly to Prime Minister Boris Johnson later today (4 December) with the demands, and will give the Government seven days to respond before Morgan pursues court action.
Morgan said: “Since the government intends to keep non-essential retail, gyms, churches and hairdressers open in Tier 3 as well as a whole country relaxation for three households to socialise over Christmas which all have similar if not higher risk factors, the treatment of the pub, bar and restaurant sector in tier 2 and tier 3 seems particularly harsh and discriminatory.
“It lacks any clarity or assurances to the sector which has on the whole operated in line with the guidance issued by the Government, as such until such time as the government supplies adequate informed action to support their actions, this pending case will be brought before the high court for review.”
